Terms of Service
1. Agreement
By using CMAXSHIPPING services, you agree to these Terms and Conditions. These terms constitute a legally binding contract between you and CMAX Shipping (“we,” “us,” or “our”).
2. Services
We provide logistics, freight forwarding, and delivery services. All services are subject to these terms, our quoted rates, and the information provided on our shipping documents.
3. Customer Responsibilities
You are responsible for:
* Accurate and complete shipping information (address, contents, value).
* Proper packaging, marking, and labeling of shipments.
* Compliance with all applicable laws, regulations, and export/import controls.
* Payment of all charges, including duties and taxes, as applicable.
4. Prohibited Items
Shipments must not contain hazardous materials, illegal goods, perishables, cash, firearms, or other prohibited items as defined by law or our company policy. We may inspect any shipment. Violation may result in shipment refusal, disposal, or seizure, with liability solely with the Customer.
5. Liability & Limitations
* Loss/Damage: Our liability for lost or damaged shipments is strictly limited to the lesser of: (a) the actual proven loss, (b) the declared value for carriage, or (c) $100 USD per shipment. We are not liable for consequential, indirect, or special damages (e.g., loss of income).
* Delay: We are not liable for delays caused by events beyond our reasonable control (e.g., weather, customs, mechanical issues, acts of government).
* Third Parties: We act as an agent for selected carriers. Their terms and limitations of liability also apply.
6. Claims
Any claim for loss, damage, or delay must be submitted in writing to us within 3 days from the date of delivery (or expected delivery for lost items). No claim will be processed until all outstanding charges are paid.
* NO REFUND
7. Rates & Payment
Quoted rates are subject to change. Payment terms are net [e.g., 15 days] from invoice date. We may charge interest on overdue amounts and suspend service for non-payment.
* Packages that are overdue to more than 30 days will be placed as unwanted packages and will be remove from our system. Packages will be owned by the company.
8. Right to Refuse Service
We reserve the right to refuse or suspend service to any Customer for any reason, including violation of these terms.
9. Governing Law & Disputes
These terms shall be governed by the laws of Jamaica. Any dispute shall be resolved in the courts.
10. Amendments
We may amend these terms at any time. The current version will be posted on our website. Continued use of our services constitutes acceptance of the amended terms.
